INTRODUCTION
Welcome to Surfaces Galore.
These Terms and Conditions govern your use of our website and purchases from Surfaces Galore.
By placing an order, you agree to these Terms and acknowledge that you have had an opportunity to review the Surfaces Galore Return & Refund Policy, Shipping Policy, Privacy Policy, and any other policies or disclosures presented in connection with your purchase.
Surfaces Galore specializes in natural stone products. Natural stone inherently varies in color, shade, veining, movement, texture, surface characteristics, dimensions, thickness, and other natural features.
Nothing in these Terms is intended to waive, restrict, or eliminate any consumer right, warranty, remedy, limitation period, or other protection that cannot lawfully be waived or limited.
1. GENERAL
1.1 Acceptance of Terms
By using our website or purchasing products from Surfaces Galore, you agree to these Terms and applicable store policies.
1.2 Changes to Terms
Surfaces Galore may update these Terms from time to time. Changes will apply prospectively to the extent required by applicable law. The terms and policies applicable to a transaction will generally be those presented or otherwise applicable when the transaction occurred.
2. ORDERS
2.1 Order Acceptance
All orders are subject to product availability, payment verification, shipping feasibility, fraud review, pricing accuracy, and acceptance by Surfaces Galore.
We may reasonably refuse, limit, hold, or cancel an order, including because of inventory errors, pricing or listing errors, payment problems, suspected fraud, shipping restrictions, product unavailability, safety concerns, or inability to fulfill the order.
If Surfaces Galore cancels an order for reasons not caused by the customer and merchandise has not been provided, amounts collected for the canceled merchandise will be refunded as appropriate.
2.2 Order Confirmation
An automated order confirmation acknowledges receipt of an order and does not necessarily constitute final acceptance or a guarantee of inventory availability.
2.3 Customer Information
Customers are responsible for providing complete and accurate billing, shipping, email, telephone, and delivery information. The customer is responsible for promptly reviewing the order confirmation and notifying Surfaces Galore of any apparent ordering or address error before fulfillment whenever reasonably possible.
2.4 Cancellations
Because orders may be processed quickly, cancellation requests should be submitted as soon as possible and preferably within 2 hours after purchase.
A cancellation is not effective until confirmed by Surfaces Galore.
Cancellation charges, when applicable, will be determined under the Surfaces Galore Return & Refund Policy and applicable law.
If an order has already shipped, it cannot be canceled and must follow the applicable return procedure if otherwise eligible.
Custom, fabricated, special-order, made-to-order, imported-to-order, or specially procured merchandise may become non-cancelable once production, fabrication, procurement, or special handling has begun.
2.5 Product Images & Samples
Product photographs, installed photographs, samples, videos, digital renderings, and other representations are provided to demonstrate the general appearance and characteristics of natural stone.
They do not guarantee an exact match in color, shade, veining, movement, texture, thickness, dimensions, finish, surface character, or production lot.
A sample does not guarantee that a future full order will exactly match the sample.
3. PRICING & PAYMENT
3.1 Pricing
Prices are shown in U.S. dollars unless otherwise stated. Prices, product availability, discounts, and promotions may change without notice before an order is placed.
3.2 Payment
Full payment or an approved payment authorization is required before an order is processed unless Surfaces Galore expressly agrees otherwise in writing.
3.3 Payment Authorization
By submitting payment information, the person placing the order represents that they are authorized to use the selected payment method and that the billing and transaction information provided is accurate to the best of their knowledge.
Surfaces Galore may use reasonable fraud-prevention and payment-verification measures and may delay, hold, or cancel fulfillment when additional verification is reasonably required.
3.4 Pricing & Listing Errors
We make reasonable efforts to maintain accurate product information. If a material pricing, quantity, availability, description, or listing error is discovered before fulfillment, Surfaces Galore may contact the customer to correct the order or cancel the affected portion and issue an appropriate refund.
4. SHIPPING & DELIVERY
4.1 Carriers
Surfaces Galore may use USPS, UPS, FedEx, freight carriers, local carriers, or other transportation providers depending on the shipment.
4.2 Delivery Estimates
Processing, shipping, freight, and delivery dates are estimates unless expressly guaranteed in writing. Surfaces Galore is not responsible, to the maximum extent permitted by law, for third-party carrier delays or circumstances outside our reasonable control.
Customers should not schedule demolition, installers, contractors, or other project work based solely on an estimated delivery date. Customers should wait until all material has been received and inspected.
4.3 Expedited Handling
Unless expressly stated otherwise, expedited handling relates to the priority given to warehouse processing and does not itself guarantee carrier transit or a particular delivery date.
4.4 Freight Deliveries
Freight shipments may require a valid telephone number and delivery appointment. Customers are responsible for providing accurate delivery information and reasonable access to the delivery location.
Customer-caused charges such as redelivery, storage, address correction, missed appointments, customer refusal, waiting time, or inaccessible delivery locations may be charged to the customer where applicable.
4.5 Curbside Delivery
Unless otherwise expressly arranged in writing, freight delivery is curbside delivery. Inside delivery, forklift service, special handling, limited-access service, and similar services may incur additional charges.
4.6 Inspection at Delivery
The customer or receiving party should inspect the shipment and exterior packaging at delivery whenever reasonably possible. Visible freight damage should be noted on the carrier's delivery paperwork or Bill of Lading before signing, and photographs should be taken of the pallet, cartons, labels, damaged areas, and delivery paperwork.
Additional damage-reporting requirements are stated in the Surfaces Galore Return & Refund Policy and Shipping Policy.
4.7 Proof of Delivery
Carrier tracking, delivery scans, signed delivery receipts, Bills of Lading, photographs, geolocation or delivery records supplied by a carrier, and other ordinary-course delivery records may be used as evidence of shipment and delivery. Such records do not eliminate any rights that applicable law or applicable payment-network rules do not permit the parties to waive.
4.8 Risk of Loss
Risk of loss and responsibility for goods during transportation will be determined according to applicable law, the applicable shipping arrangement, carrier terms, and any valid agreement between Surfaces Galore and the customer.
Nothing in these Terms is intended to transfer risk of loss to a consumer earlier than permitted by applicable law.
5. RETURNS, REFUNDS & EXCHANGES
All returns, refunds, cancellation requests, exchanges, incorrect-item claims, damage claims, and related procedures are governed by the Surfaces Galore Return & Refund Policy applicable to the transaction.
Generally:

Standard return authorization must be requested within 30 calendar days of delivery.

Only eligible full-order customer-choice returns are accepted.

Merchandise must satisfy all return-condition requirements.

Customer-choice returns may be subject to a 25% restocking fee as described in the Return & Refund Policy and to the extent permitted by law.

Original shipping is generally non-refundable for customer-choice returns.

Customers generally pay return freight on customer-choice returns.

Final-sale merchandise is not eligible for an ordinary return.

Installed, cut, sealed, modified, or altered material is not eligible for an ordinary return.
A confirmed Surfaces Galore fulfillment error or legally cognizable product claim will be evaluated separately under the Return & Refund Policy and applicable law.
If these Terms and the Return & Refund Policy appear inconsistent concerning a return procedure, the more specific Return & Refund Policy will govern that procedure to the extent permitted by applicable law.
No customer is entitled to duplicate recovery for the same transaction. If a refund, credit, replacement, chargeback credit, insurance payment, or other recovery has already been provided for the same loss, Surfaces Galore may provide evidence of that recovery to the appropriate bank, processor, carrier, insurer, or other party and may seek correction of any duplicate recovery to the extent permitted by law.
6. INSPECTION BEFORE INSTALLATION
ALL MATERIAL MUST BE INSPECTED BEFORE INSTALLATION, CUTTING, SEALING, MODIFICATION, OR ALTERATION.
The customer and installer are responsible for verifying reasonably discoverable characteristics including product, stone type, color, shade, finish, size, thickness, quantity, pattern, condition, variation, layout, and general suitability.
Installation, cutting, sealing, modification, or alteration constitutes acceptance of conditions and discrepancies that were reasonably discoverable through inspection before installation.
If the customer or installer believes the merchandise is incorrect, damaged, defective, materially different, or otherwise unsuitable:
STOP INSTALLATION IMMEDIATELY AND CONTACT SURFACES GALORE BEFORE PROCEEDING.
Installed, cut, sealed, modified, or altered merchandise is not eligible for an ordinary return, exchange, refund, or store credit except where otherwise required by applicable law.
Surfaces Galore is not responsible for customer selection errors, installer errors, failure to inspect, improper installation, substrate preparation, waterproofing, setting materials, grout selection, sealer selection or application, layout decisions, jobsite conditions, or third-party workmanship.
To the maximum extent permitted by applicable law, Surfaces Galore is not responsible for labor, demolition, removal, reinstallation, contractor charges, project delays, loss of use, or other installation-related costs resulting from material installed after there was a reasonable opportunity to inspect the reasonably discoverable condition at issue.
7. NATURAL STONE CHARACTERISTICS
Natural stone is inherently variable. Normal characteristics may include color variation, shade variation, veining, mineral deposits, movement, fossils, pits, pinholes, voids, fissures, fill, surface variation, texture variation, edge variation, thickness variation, and dimensional tolerances.
Normal natural characteristics reasonably consistent with the product description are not considered defects.
Natural stone should not be expected to look identical from piece to piece, carton to carton, pallet to pallet, sample to order, or shipment to shipment.
8. NOMINAL DIMENSIONS
Unless expressly stated otherwise, natural-stone sizes are nominal.
Reasonable variations may occur in length, width, thickness, squareness, bevel, edge profile, and surface finish.
Customers who require exact measurements or tight fabrication tolerances for a particular installation should contact Surfaces Galore before ordering and obtain written confirmation of any critical requirement.
9. REORDERS & LOT VARIATION
An additional or future order may not match previously purchased material.
Surfaces Galore does not guarantee exact matching between samples and full orders, separate orders, separate shipments, different production runs, different blocks of natural stone, or existing installations and later purchases.
Customers requiring additional material for an existing installation should contact Surfaces Galore before ordering. Even when prior order information is supplied, an exact match cannot be guaranteed unless Surfaces Galore expressly confirms otherwise in writing.
10. CHECKERBOARD & MIXED-STONE INSTALLATIONS
Checkerboard designs and mixed-stone installations may combine different natural stones and materials from different production lots, stone blocks, fabrication facilities, or production runs.
Reasonable differences in size, thickness, shade, finish, edge, or stone characteristics may occur.
Customers and installers should dry-layout and inspect all materials before installation.
If the customer believes the pieces cannot reasonably be used together, installation must stop and Surfaces Galore must be contacted before material is cut, altered, or installed.
11. SWITCH PLATES, WALL PLATES & SPECIALTY ACCESSORIES
Natural-stone wall plates and specialty accessories may have fabrication tolerances.
Unless expressly stated otherwise, published measurements generally refer to exterior product dimensions.
Surfaces Galore does not guarantee universal compatibility with every electrical box, switch, outlet, screw configuration, wall condition, or installation method.
Customers are responsible for confirming compatibility before ordering. This provision does not excuse a confirmed Surfaces Galore fulfillment error or any obligation that applicable law does not permit us to exclude.
12. INSTALLATION & PRODUCT SUITABILITY
Surfaces Galore sells natural-stone products and does not control third-party installation unless installation services are separately contracted in writing.
General statements regarding possible applications are informational and do not replace evaluation by a qualified installer, contractor, architect, engineer, building official, or other appropriate professional.
Suitability can depend on substrate, climate, waterproofing, freeze/thaw exposure, slip-resistance requirements, setting materials, traffic, structure, building codes, installation method, maintenance, and other project-specific conditions.
Customers should confirm project-specific suitability before purchase and installation.
13. WARRANTIES
Nothing in these Terms disclaims or limits any implied warranty, express warranty, statutory warranty, or consumer protection that cannot legally be waived.
Except for warranties or legally enforceable affirmations expressly made by Surfaces Galore in connection with a transaction, or warranties imposed by applicable law, Surfaces Galore does not create additional warranties merely by providing general product information, photographs, samples, design suggestions, or general installation information.
Any manufacturer's warranty, where applicable, is subject to that manufacturer's terms, except to the extent applicable law provides otherwise.
14. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Surfaces Galore will not be responsible for indirect, incidental, special, or consequential losses resulting from customer selection errors, installation errors, third-party workmanship, misuse, failure to inspect reasonably discoverable conditions, or circumstances outside Surfaces Galore's reasonable control.
Where legally permitted, monetary liability arising solely from nonconforming merchandise may be limited to the amount paid for the affected merchandise or another remedy permitted by applicable law.
Nothing in these Terms excludes or limits rights or remedies that cannot legally be excluded or limited, liability that applicable law prohibits us from limiting, or personal-injury or other damages to the extent a contractual limitation would be invalid or unenforceable.
15. CUSTOMER MEASUREMENTS & QUANTITIES
Customers and their installers are responsible for project measurements and determining required quantities.
Surfaces Galore generally recommends approximately 10%–20% overage, depending on material, pattern, cuts, layout, selection, natural variation, and project requirements.
Additional orders may not match previous material.
16. PRODUCT CARE
Natural stone may require sealing, maintenance, cleaning, or other care depending on the stone, finish, application, and environment.
Customers should follow applicable manufacturer instructions and recommendations from their qualified installer.
Surfaces Galore does not guarantee the performance or compatibility of third-party cleaners, sealers, adhesives, grout, setting materials, or maintenance products unless expressly stated in writing.
17. PAYMENT DISPUTES & CHARGEBACKS
Customers are encouraged to contact Surfaces Galore promptly regarding any order, delivery, product, return, cancellation, or refund concern so that Surfaces Galore has a reasonable opportunity to investigate and attempt to resolve the matter.
If a chargeback, payment dispute, payment inquiry, or similar claim is initiated, Surfaces Galore may provide the card issuer, payment processor, acquiring bank, payment network, carrier, insurer, or other appropriate party with relevant documentation concerning the transaction and the customer's claim.
Relevant documentation may include order confirmations and invoices; product descriptions and photographs applicable at the time of purchase; billing and shipping information; payment-verification and fraud-screening information; IP address and transaction data; tracking and delivery confirmation; Bills of Lading and delivery signatures; carrier records; delivery photographs; product, carton, pallet, and label photographs; customer communications; return or cancellation requests; refund, credit, replacement, or reshipment records; evidence that merchandise was received, retained, used, cut, installed, sealed, modified, or altered; applicable policies and disclosures presented in connection with the transaction; and other records reasonably related to the dispute.
Surfaces Galore may contest any payment dispute that it reasonably believes is inaccurate, unsupported, duplicative, fraudulent, inconsistent with transaction records, or otherwise subject to challenge under applicable payment-network rules.
If a customer has received and retained merchandise, installed or altered merchandise, received a replacement, received a refund or credit, or otherwise received the benefit of the transaction, Surfaces Galore may submit evidence of those circumstances in response to a payment dispute.
A customer is not entitled to obtain duplicate reimbursement for the same loss through both Surfaces Galore and a payment dispute or other recovery mechanism. If duplicate recovery occurs, Surfaces Galore may seek correction or recovery to the extent permitted by applicable law and applicable payment-network rules.
Filing a chargeback or payment dispute does not by itself alter the contractual rights or obligations of either party, except to the extent determined by the applicable bank, processor, payment network, court, or applicable law.
Nothing in this section prohibits a customer from exercising any legitimate payment-dispute, chargeback, statutory, or consumer-protection right that cannot lawfully be waived. Nothing in the chargeback process waives any right or remedy otherwise available to Surfaces Galore under applicable law.
18. CLAIM DOCUMENTATION & PRESERVATION OF EVIDENCE
A customer asserting damage, shortage, incorrect merchandise, nonconformity, or another product-related claim should preserve the affected merchandise, cartons, packaging, labels, pallet materials, delivery paperwork, and other reasonably relevant evidence until Surfaces Galore completes its review or provides written instructions.
The customer should provide reasonable photographs, identifying labels, quantities, order information, and other documentation requested to evaluate the claim.
The customer should not discard, destroy, install, cut, seal, modify, or otherwise materially alter merchandise that is the subject of a pending claim unless necessary for safety or unless Surfaces Galore provides written authorization, except where applicable law provides otherwise.
Failure to preserve reasonably available evidence may affect Surfaces Galore's ability to verify a claim or pursue a carrier or insurance claim, but nothing in this section eliminates rights that cannot lawfully be waived.
19. ELECTRONIC RECORDS & TRANSACTION DOCUMENTATION
To the extent permitted by applicable law, Surfaces Galore may maintain electronic records of transactions and communications in the ordinary course of business. Such records may include order and checkout records, timestamps, policy versions, payment and fraud-screening data, customer emails and messages, shipping and tracking records, Bills of Lading, photographs, return authorizations, refund records, and customer-service communications.
These records may be used to investigate a transaction, administer a return or claim, respond to a payment dispute, or establish relevant transaction facts. Nothing in this section makes any record conclusive where applicable law or payment-network rules provide otherwise.
20. FORCE MAJEURE
To the extent permitted by applicable law, Surfaces Galore will not be liable for delay or failure caused by events outside our reasonable control, including natural disasters, severe weather, government actions, war or civil disturbance, labor disruptions, transportation interruptions, carrier failures, supply-chain disruptions, port closures, or material shortages.
21. INDEMNIFICATION
To the extent permitted by applicable law, the customer agrees to indemnify and hold Surfaces Galore harmless from third-party claims arising from the customer's unlawful misuse of products, unauthorized modification, or improper installation when such claims are attributable to the customer's conduct and not to Surfaces Galore's breach, negligence, or other legal responsibility.
Nothing in this provision requires a consumer to indemnify Surfaces Galore for liability that cannot lawfully be shifted to the consumer.
22. INTELLECTUAL PROPERTY
Website content owned by Surfaces Galore, including original photographs, text, designs, graphics, logos, and other proprietary material, may not be commercially copied, reproduced, distributed, or used without authorization, except where such use is otherwise permitted by law.
23. NO UNAUTHORIZED MODIFICATION OF TERMS
Customer-service employees, contractors, installers, freight carriers, and third parties are not authorized to modify these Terms on behalf of Surfaces Galore unless the modification is expressly confirmed in writing by an authorized Surfaces Galore representative.
Nothing in this section eliminates an express warranty, representation, or other obligation that applicable law independently makes enforceable.
24. TIME LIMITS FOR CLAIMS
Return requests, shipping claims, incorrect-item reports, and other administrative procedures should be submitted within the reporting periods specified in the applicable Surfaces Galore policies.
Any lawsuit or legal action must be brought within the limitation period permitted by applicable law.
Nothing in these Terms shortens a statutory limitation period below the minimum period permitted by applicable law.
25. GOVERNING LAW
To the extent permitted by applicable law, these Terms and purchases from Surfaces Galore will be governed by the laws of the State of California, without regard to conflict-of-law principles.
Nothing in this provision deprives a consumer of mandatory protections that applicable law provides.
26. VENUE
Where legally permitted and where the parties may validly agree to venue, disputes involving Surfaces Galore will be brought in an appropriate court located in Orange County, California.
Nothing in this provision prevents a consumer from using a jurisdiction or venue that applicable law gives the consumer and does not permit the parties to waive.
27. SEVERABILITY
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent legally permissible or severed as appropriate. The remaining provisions will continue in effect.
28. ENTIRE AGREEMENT & POLICY PRIORITY
These Terms, together with the policies incorporated into them and any transaction-specific written agreement, constitute the applicable agreement between Surfaces Galore and the customer concerning the transaction.
For matters specifically governed by the Return & Refund Policy or Shipping Policy, the more specific policy will control over a conflicting general provision in these Terms to the extent permitted by applicable law. A transaction-specific written agreement expressly accepted by Surfaces Galore may control over inconsistent general terms to the extent stated in that agreement.
